TERMS AND CONDITIONS


The following Terms and Conditions apply to all bookings made. Please take a moment to
read them prior to making a Booking.


The Company enters into this Contract as principal for Bookings made for the hotel it
operates.

 

In these Terms and Conditions the following definitions apply:


1. Interpretation

 The following definitions and rules of interpretation apply to this licence.

 1.1.         Definitions

Company” or “we” or "us" means Steep Hill Properties Ltd, Company Registered in England and Wales number 13187930 (The Rest), registered office address, 55A Steep Hill, Lincoln, LN2 1LR.


Booking” means the booking for accommodation, functions and/or any other services or items made with us.

Contract” means the Booking and these Terms, and any other terms and conditions stated to apply to the Booking.

Hotel” means the premises for which your Booking is made.

"Rooms" the room described in the Hotel Booking.

Terms” means these terms and conditions.

Websites” means www.theresthotellincoln.co.uk or any other website owned or operated by us relating to a Hotel from time to time.

VAT” means value added tax.

"Access Ways" the pedestrian ways and driveways within the external areas of the Hotel.

"Common Parts" the entrance halls, corridors, stairwells and lifts serving the Room.

1.2.         Clause headings shall not affect the interpretation of these terms and conditions.

1.3.         Unless the context otherwise requires, words in the singular shall include the plural and in the plural shall include the singular.

1.4.         Unless the context otherwise requires, a reference to one gender shall include a reference to the other genders.

1.5.         References to clauses are to the clauses in these terms and conditions.

1.6.         A reference to a statute or statutory provision is a reference to it as amended, extended or re-enacted from time to time.

1.7.         A reference to a statute or statutory provision shall include all subordinate legislation made from time to time under that statute or statutory provision.

 2.     Booking for accommodation 

2.1.         The Company permits the Customer for the period of the Stay Duration to:-

 a)    Occupy the Room; and

b)    Pass along the access ways and common parts, in common with the company, its employees, servants or agents or others authorised by the Company.

 2.2.         The Customer acknowledges that:-

a)    The Customer shall occupy the Room in the capacity of a hotel guest and that no relationship of landlord and tenant is created between the Company and the Customer by these terms and conditions;

b)    The Customer shall not be entitled to any statutory protection under the Housing Act 1988;

c)     The Company retains control and possession of the Room and the remainder of the hotel and the Customer has no right to exclude the Company from the Room or remainder of the hotel.

3.     Bookings 

3.1.         All Bookings online or at the Hotel are subject to these Terms.

3.2.         At the time of booking we may take a bank transfer or in the case of your credit/debit card details, you authorise the use of this card for any sums that become owing to us. We shall also have the right to require full payment in advance and a deposit at the time of booking in certain circumstances or if the Booking includes the supply of certain items or services. No Booking shall be treated as confirmed until the details and/or payment/deposit described in this paragraph have been provided and confirmation in writing issued to you by the Company.

 4.     Charges 

4.1.         The prices displayed on the Websites are an average per night / per person until a rate is selected. Any meals, service or VAT (at the prevailing rate) are included only if specified. A minimum length of stay, deposit, cancellation charge and other conditions may apply to certain rates, as specified. Once a rate is selected on the Websites, the total for your requested stay shall be displayed on the reservation summary.

4.2.         Occasionally errors can occur in pricing and we reserve the right to amend errors and omissions on the booking system and verbally. Reservations made may be amended or cancelled if an error in pricing is noticed prior to the stay.

4.3.         Prices shall be charged in the local currency of the Hotel and any currency conversion facility is provided as an approximation tool only.

4.4.         The VAT breakdown shown is indicative based on the current rate of VAT, and the expected VAT treatment of the goods or services. VAT will be payable at the prevailing rate applicable at the tax point of the invoice or Booking confirmation issued, and may change depending on the actual rate and the VAT treatment of the goods and services purchased at that date.

4.5.         Price lists for additional items are on display at relevant locations within the Hotel and are available on request.

5.     Check-in/Check-out Time  

5.1.         In the interests of security and to prevent fraud, at the time of check-in, guests may be required to confirm their identity by providing their booking reference and their passport/identity card/driving licence. If guests are travelling from outside the UK or Ireland we are also obliged by law to require guests to provide the number and place of issue of your passport/identity card and details of their next destination. For some extended stays it may be necessary to undertake enhanced checks. These records will be kept for at least 12 months and may be disclosed or made available for inspection by any police officer or as otherwise required by applicable law in connection with the prevention or investigation of crime. The information above may be requested for each member of your party over the age of 16 and we reserve the right to refuse entry to persons who cannot provide the information set out above.

5.2.         Unless otherwise stated on the booking confirmation, Guests may check-in at any time from 3.00 p.m. on the scheduled day of arrival. 

5.3.         On the day of departure we kindly ask all guests to vacate their rooms by  11.00 am (unless a later departure is stated as part of your Booking). Late check-out after this time can be requested subject to availability and will be charged at an hourly rate at the discretion of the Hotel.

5.4.         Rooms are subject to maximum occupancy rules. 2 persons per studio room,
persons for 1 bedroom apartments and 3 persons for 2 bedroom apartments,  set by the Hotel. If you would like further details, please contact the Company or the Hotel.

5.5.         Rooms might be extended with our Contract and subject to availability, provided that:

 5.5.1.     For stays of less than 1 month, you give us at least 24 hours advance written notice if any extension; and

5.5.2.     For stays of more than 1 month you give us at least 2 weeks advance written notice of any extension.

5.5.3.     We reserve the right to enter your room in the event of emergency, to allow us to clean the Room or for any other reasonable reason.

 6.     Payment 

6.1.         For long stay guests, advance monthly payments are to be made by bank Transfer. Additional methods of payment: credit cards: MasterCard, Visa; debit cards - Visa/Delta and Visa/Electron which must be paid in advance when using online payment.

6.2.         At the time of booking we may authorise the accommodation charges (room rate, VAT and any service charge) and anticipated incidentals for the duration of your stay against your credit/debit card.

6.3.         For stays of less than a month, the full payment for your booking will be taken on the booking card prior to your arrival.

6.4.         For stays of a month or more, payment of a month's charges will be required monthly in advance.

6.5.         A security deposit may be requested and charged. This will be refunded in full on vacating the accommodation leaving it in a reasonable condition. Alternatively, the Company may take a pre-authorisation on a credit or debit card.

7.     Cancellation Policy and No Shows 

7.1.         The cancellation policy varies according to the policy in place at the time booked and is stated on the booking confirmation. Bookings made through any channel partners may vary and are stated in terms on the channels site and/or on the booking confirmation.

7.2.         Bookings cancelled 7 days or less before the date of stay or for non-cancellable bookings and no shows shall become non-cancellable, non-transferable and nonrefundable in all circumstances.

7.3.         All notice periods are from 23:59 pm.

7.4.         Bookings cancel more than 7 days in advance of the stay will be refunded within 72 hours of a cancellation request.  

8.     Changes or Cancellation by the Company

 8.1.         Very occasionally we may need to cancel your booking. In such circumstances you will be given a full refund, but we shall have no further liability to you arising out of such cancellation. We will, however, use reasonable endeavours to try and re-locate any confirmed Booking cancelled by us to an alternative location similar in standard to the Hotel.

8.2.         Your booking is for a class of room in the Hotel and does not guarantee that you will be able to stay in a specific room or in the same room for the duration of your stay. If we need to move you to a different room during your booking for which a lower rate is available than the rate you booked at, we will refund you the difference in the rates.

 9.     Loss and Damage Charges 

9.1.         We reserve the right and you hereby authorise us to charge your credit or debit card or withhold from any deposit paid for any damage or loss incurred to your room or the Hotel during your stay (including without limitation specialist cleaning) or for any items that are missing when you leave.

9.2.         A charge of £25 is charged for loss or non return of keys. The keys are specialist security keys and cannot be made at local key cutting shops which is why there is a high cost. This includes the cost of postage.

9.3.         Specialist cleaning for smoking in a room - from £100

9.4.         Carpet clean due to food/drink damage - £75

9.5.         Damage repairs and replacement to any fixtures, fittings or furnishing’s - at cost plus administration charge of £50

 10.  Accessibility

availability of appropriate accommodation, and we will do our best to accommodate
your needs.  

11.  Hotel Events 

Please be aware that at certain times throughout the year our hotels may host events
and parties, which you may feel would be an intrusion. Please contact the Hotel
directly in advance of your stay for further information.

12.  Guest Behaviour  

12.1.      Guests are requested to conduct themselves appropriately at all times and to
comply with Company procedures (including Welcome Pack and Safety Induction) and/or requests with regard to conduct and respect for the property  if the Hotel, its employees, Contractors and guests and their health and safety.

12.2.      Guests are requested not to disrupt the comfort and enjoyment of other guests, the smooth running of the Hotel, or cause offence to other guests or our members of staff. We reserve the right to refuse accommodation or services or  remove you and members of your party from the Hotel if, in our reasonable opinion, we consider this provision to have been breached. Where this is the case we shall have no obligation to refund you for lost accommodation, other services or any other loss or expense incurred.  

13.  No Smoking and zero tolerance drugs policy 

13.1.      Guests are not permitted to smoke in rooms or public areas, other than outside
areas where designated. Anyone smoking in the room will be charged a minimum £100 specialist cleaning charge. Where a room can't be let due to  smoke an extra charge may also be levied.

13.2.      The Company operates a zero-tolerance policy in relation to the use of illegal drugs at the Hotel and reserves the right to terminate this Contract immediately should such usage occur.

 14.  Children

 14.1.      All children (a person under 18 years of age) staying at the Hotel must be accompanied by an adult and must be supervised by an adult at all times.

14.2.      Cots and extra beds are not available at the Hotel.

 15.  Pets

Guide dogs and assistance dogs are accepted by prior written arrangement, but otherwise no pets are allowed at the Hotel.

 16.  Personal Information  

16.1       Telephone calls may be recorded from time to time to help us improve the service we offer you.

 16.2       All personal information stored and used by us is done so in accordance with our Privacy Policy and Cookie Policy, which are available on

 17.  Force Majeure  

The Company accepts no liability and will not pay any compensation where the
performance of its obligations is prevented or affected directly or indirectly by or as a
result of force majeure or any circumstances beyond its reasonable control including,
but not limited to, pandemic, disease, mandated closure by government or others,
flood, earthquake, extreme adverse weather conditions, natural disasters, other acts
of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility
service, plant machinery, computers, vehicles or any collapse of building structures.

18.  Limitation of Liability  

18.1       The Company will not be responsible for the loss or damage of any property left in the Hotel other than as required under the Hotel Proprietor’s Act 1956 or  any other applicable law.

18.2       The Company will not be liable for any indirect, consequential or pure economic
loss or any loss of profit, goodwill or opportunity (whether caused by the negligence of the Company, its employees, Contractor or agents or otherwise). The Company’s total liability shall not exceed the value of the charges received by it under the Contract.

18.3       Nothing contained in the Contract or in any other document referred to or
incorporated in it shall be read or construed as excluding any liability for death or personal injury caused by the Company’s negligence or liability for fraud or
fraudulent misrepresentation.

 19.  Transfer of Contract 

19.1       We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the Contract.

19.2       You may not transfer your rights or your obligations under these terms to another person unless we have given prior written permission for you to do so.

19.3       Nobody else has any rights under this Contract (except someone you pass your guarantee onto). This Contract is between you and us. No other person shall have any rights to enforce any of its terms.

 20.  Termination 

20.1       The Contract shall end on the earliest of:- 

a)    The expiry of not less than 1 weeks' notice given by the Company to the Customer if the Customer breaches any of the Customer's obligations contained in these terms and conditions; 

b)    The expiry of not less than 28 days' notice given by either party to the other;

c)     The expiry of the Stay Duration.  

20.2       Termination of the Contract shall not affect the rights of either party in connection with any breach of any obligation under the terms and conditions which existed at or before the date of termination.

21.  Costs

The Customer will pay the costs and expenses of the Company including any other professionals costs and expenses (inured both during and after the end of the Contract for whatever reason) in connection with or in contemplation of either of the following:- 

a)    The enforcement of the Customer's obligations under these terms and conditions including any Court proceedings; and

b)    Serving any Notice and taking any Court proceedings as a consequence. 

 22     Governing Law and Jurisdiction 

22.1       These terms and conditions and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

22.2       Each party irrevocably agrees that the Courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this licence or its subject matter or formation (including non-contractual disputes or claims).

 23     Website Information 

23.1       While all reasonable efforts have been taken to ensure the accuracy of information on the Websites, the Company does not accept responsibility for errors or omissions and reserve the right to amend, cancel or vary any of the  arrangements featured on the Websites without notice. Please note that in certain circumstances, generic photographic images have been used to represent the general style of a particular product or hotel.

23.2       The content of the Websites is the copyright of the Company, and may not be
copied, reproduced, published, distributed or amended for any other purpose
without our prior written consent.

23.3       Trademarks used on the Websites are the property of the respective owners.
Hyperlinks to third party websites are provided for your convenience. We cannot accept responsibility for the content or use of third-party sites.

23.4       The Websites are operated by the Company
